Terms of Service

These Terms of Service ("Terms") govern your access to and use of Command Post, an operations-management platform for service businesses that is operated by Hinkle Productions ("we," "us," or "our"). Please read them together with our Privacy Policy.
1. Acceptance of Terms
By creating an account, accepting an invitation, signing in, or otherwise using Command Post, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Command Post.
2. Eligibility and Authority
You must be old enough to form a binding agreement where you live and be using Command Post for business purposes. If you use Command Post on behalf of a company or other organization, you represent that you have authority to bind it to these Terms, and "you" includes that organization.
3. Accounts and Security
- Provide accurate account information and keep it up to date.
- Keep your sign-in credentials confidential and do not share your account.
- You are responsible for activity under your account and, for organizations, for the users you authorize.
- Tell us promptly if you suspect your account or a connected service has been compromised.
4. Organization (Tenant) Responsibility
Each company that uses Command Post (a "tenant") is responsible for and controls:
- who its users are, and the roles and permissions those users hold;
- which third-party integrations it connects and disconnects;
- the employee, customer, financial, and other data it enters, imports, or connects;
- its own compliance with the laws that apply to its business and its use of the service, including employment, privacy, communications, and record-keeping laws.
The service is not run by, and is not the responsibility of, any tenant other than the one you belong to. A tenant that is a beta user, such as an early customer, is a customer of the service, not its operator.
5. Acceptable Use
You agree not to:
- use the service for unlawful, fraudulent, deceptive, or abusive purposes;
- access or attempt to access accounts, tenants, or data you are not authorized to access;
- upload or transmit malware or other harmful code;
- bypass, probe, or disable security or permission controls;
- infringe the intellectual property or privacy rights of others;
- send spam or unsolicited communications, or misuse messaging features;
- misuse connected integrations or violate the terms of the connected provider;
- scrape, copy, or reverse engineer the service except where the law expressly permits it;
- interfere with the availability, integrity, or performance of the service.
6. Third-Party Integrations
Command Post can connect to external services, such as Intuit QuickBooks Online and Google Workspace today, and other services such as Microsoft, messaging or email providers, and industry-specific platforms in the future. Please note:
- Each third-party service has its own terms and privacy policy, which apply to your use of that service.
- We are not responsible for third-party outages, changes, limits, or decisions, and a connected feature may stop working if the provider changes or if authorization is revoked.
- When you connect a service you authorize us to access it only to provide the functions you have enabled.
- You can disconnect an integration where the product supports it, and you can also revoke access from within the provider's own account settings.
7. Financial Information
Command Post may display information read from QuickBooks Online or from files you upload or import. The current QuickBooks Online integration is read-only: it does not create, change, or delete anything in your QuickBooks company unless a future feature clearly says otherwise and you enable it.
Command Post does not provide accounting, tax, legal, investment, payroll, or financial advice. Reports shown in Command Post are for operational awareness and may differ from your source records because of timing, accounting basis, imports, or third-party data issues. You remain responsible for reviewing your source accounting records and for the decisions you make.
8. Communications and Notifications
Depending on the features you and your organization use, we or the service may send:
- account and service emails, such as sign-in, email-change, invitation, and security messages;
- operational notifications, in the app and, where enabled, by email;
- text (SMS) messages, only where a user or tenant enables them and the required consent has been obtained (see Section 9).
We distinguish service and transactional messages, which relate to your account or the work you use the service for, from optional promotional messages. Promotional messages are sent only where applicable consent has been given and with an opt-out. Accepting these Terms does not authorize future marketing messages. Message frequency varies with how you use the service. Essential account and security notices may still be sent through available channels even if you have opted out of optional messages.
9. SMS / Text Messaging
Command Post does not currently send text messages. If and when text messaging features are made available, the following applies:
- Texts are sent only to numbers for which express consent has been obtained for that type of message. Consent is captured at the time of opt-in and a record of it is kept.
- Each message identifies the sender, and the opt-in explains the type and purpose of the messages.
- Message frequency varies. Message and data rates may apply.
- You can reply STOP to opt out of optional text messages at any time, and HELP for help, where supported. You may also contact us at the address in Section 23.
- Consent to receive texts is not a condition of purchasing unrelated goods or services.
- Mobile opt-in data and consent are not sold or shared with third parties for their own marketing or promotional purposes.
- A tenant that uses the service to text its own employees or customers is responsible for obtaining lawful consent, identifying itself, honoring opt-outs, and complying with applicable messaging laws.
10. Email Communications
You may receive service and account emails from the service. Optional marketing email is sent only with applicable consent and includes a way to opt out. Emails that a tenant creates or sends through the service remain that tenant's responsibility, including their content and lawful recipients.
11. Google, Microsoft, and Other Third-Party User Data
Data we receive from a connected provider is accessed and used only to provide the user-facing functionality you enabled, and remains subject to that provider's terms and policies as well as our Privacy Policy. We request only the access needed for the features enabled at the time you connect.
12. Intellectual Property
Command Post, including its software, design, and branding, is owned by Hinkle Productions and its licensors and is protected by intellectual property laws. These Terms give you a limited right to use the service; they do not transfer ownership. Tenants keep ownership of the business and customer content and data they submit ("Customer Data").
13. Customer Data License
You grant Hinkle Productions a limited, non-exclusive license to host, process, store, transmit, and display Customer Data solely as needed to provide, secure, support, and improve the service and as described in the Privacy Policy.
14. Your Responsibility for Data
You are responsible for having the lawful right, and any required consent or notice, to upload, import, connect, or transmit the data you bring into Command Post, including employee and customer information, contact details, files, calendars, messages, and financial or accounting data.
15. Service Availability
We work to keep the service available, but we do not guarantee uninterrupted or error-free operation and do not promise a particular uptime unless we agree otherwise in writing. Maintenance, third-party outages, and beta features may affect availability.
16. Beta and Preview Features
Command Post is in active beta testing. Beta and preview features may be incomplete, change, or be removed, and may contain errors. Please keep independent records of information that is important to your business.
17. Fees and Subscription
Paid features, plans, or pricing may be introduced in the future. If they are, we will tell you about the charges before you are billed, and your use of paid features will be subject to the applicable plan terms.
18. Suspension and Termination
We may suspend or end access if we reasonably believe there is a violation of these Terms, a security risk, unlawful use, or (if fees apply) nonpayment. You may stop using the service at any time, and tenant administrators can disconnect integrations where supported. Sections that by their nature should survive termination will do so.
19. Disclaimer of Warranties
The service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the service or third-party integrations will be accurate, uninterrupted, or error-free.
20. Limitation of Liability
To the extent the law allows, Hinkle Productions will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the service. Our total liability for claims relating to the service is limited to the amount you paid us for the service in the twelve months before the claim (or, if you paid nothing, to a nominal amount). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
21. Indemnity
You will defend and indemnify Hinkle Productions against third-party claims arising from your misuse of the service, the data or content you submit, your unlawful use of the service (including messaging without required consent), or your violation of another party's rights, to the extent permitted by law.
22. Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a new date, and where a change is material we will provide additional notice where appropriate, such as in the app or by email. Continued use after a change takes effect means you accept the updated Terms.
